The process to securing veterans disability benefits can be overwhelming. If you’re claim gets denied, panic can easily set in. But don’t worry, you’re definitely not alone in this. Here’s how you can potentially overturn the decision.



Start Your Appeal

If you were unjustly denied benefits by VA you have every right to appeal the decision. In order to start the appeals process, the VA has highlighted key steps that you can follow. While this is not the only path you can take towards appeal, this is a popular course of action many will take.

  1. File a Notice of Disagreement (NOD) within one year of your denial. With this you can include any forms or evidence that support your NOD and mail it to the address indicated on your original denial letter. You also have the options to file your NOD with your VA regional office.
  2. Once the VA receives your notice, they will begin the process of reexamining your case. The VA will then send you a Statement of the Case (SOC) which will further outline the reasons why you claim was not approved.
  3. If you are not in agreement with the SOC you have the option to further appeal. In order to do so you must complete VA Form 9 with the Board of Veterans’ Appeals.
  4. If you decided to use the VA Form 9 to appeal, a decision on your claim will be made by the Board of Veterans’ Appeals and mailed to you.
  5. From here applicants who receive an unfavorable decision have the option to appeal to the United States Court of Appeals and Federal Claims.
